[US propose: Nothing in Section III (Electronic Commerce) shall be construed to prevent any Party from taking any action which it considers necessary for the protection of its own essential security interests .]

Open to interpretation, but the final clause could easily be utilized for nefarious purposes.

On Transparency:

Each Party shall ensure its laws, regulations, [procedures] and administrative rulings of general application respecting any matter covered by this Agreement are promptly published or otherwise made available in such a manner as to enable interested persons and Parties to become acquainted with them.
