Car is a 2010 dodge challenger. There are public videos of Chrysler software being hacked in jeeps, probably the same stuff running on the challenger. The brake lights are activated by a switch that comes in direct contact with the brake pedal. When the pedal is pushed the switch makes the brake lights come on even if the abs is preventing fluid access to the brake calipers. Ie you push the pedal and nothing happens...

Edit: Air bags not going off and the engine not shutting off after impact are also things to consider.
