I mean, if it's life and death, I would do the same this without guilt. It's a moot point, though, because it's all bullshit. When the guy pokes at him and says something about it could have been him there, he starts thinking (and takes a long "um" pause to do so) and looks to the left (classic tell for lying: left brain).
