I must correct you: it is a legal system. There is no justice system. When you understand the actual term, things sink in a little better on how come it's so fucked.

I'd tell the judge that you gave the police the ok to take the back panel off and physically search the phone for any drugs it may have been hiding in the battery compartment but if they can't find any in there you clearly aren't in possession of drugs as the 1s and 0s written on the hardware inside can never be considered a narcotic and as such you want the phone back and out of the cell.

4th amendment non-issue. There is no case and the warrant is baseless. The judge needs to take the place of the accused in jail.
