Only way to hurt them is to fine them a sacrilegious amount of money that far exceeds the legal cost to defend themselves against it.

carlip

I run an LG Volt that's 4 years old. Nearly everything google related is disabled and it runs very well.

NoRagrets

It is a crime under French law to intentionally shorten the life of any product in order to promote sales. The French consumer protection agency has the power to fine up to 5% of annual turnover or impose a jail term.

Should've sought a jail term.

SavageSeasons

Then fucking reverse that shit or be fined out the ass!

Conway

Drop in the bucket. Speed the fucking phones back up.

cdglow

This is such a shit decision, has unbelievable unintended consequences, and it's amazing to me that otherwise intelligent people on Voat fall for this fake pro-consumer ruling without even questioning it a little bit. Resist your programming and think about this and the consequences a little.

Every operating system update for every platform is filled with new features and/or fixes for old bugs. There is no such thing as a baseline apples to apples comparison where you can definitively say that a company made the operating system slower because it's always doing more and different things over time. Bugs and flaws are fixed. Code is refactored to enable new features to emerge. Security improvements are made. New features are added. Etc. These all take up CPU cycles and memory. But is this anti-consumer?

I fully understand that planned obsolescence exists. You want to guarantee it? Start penalizing companies for developing new features and fixes for older software and force them to stop updating features even if it would be a net win for everybody because it makes the system .000001ms slower and they'll be penalized for it after a year.

Do you understand the law of unintended consequences? Do you understand that judges and politicians can barely figure out how to turn their phone on? These are not the people who should be making decisions about your stuff. Judges do not understand technology and shouldn't be dictating to companies and consumers what products should be created in what ways.

No problem if you disagree, but tell me why I'm wrong if you think so.

SavageSeasons

I agree with you generally, but my PERSONAL belief is that these companies purposely slow down the phones in other ways that have nothing to do with the updates.

For example, I got the Note 8 last year, then downloaded the first update that came out & noticed it was a bit slower in after having installed it. This is the "best" phone they had at the time, being slowed down by updates that didn't drastically alter my phone.

My phone has never been as fast as the first few months I had it. The Note4 example given in the article makes sense, but that same scenario should not occur with one of the top phones in the market.

DICKRAGE

I never update my phone....

noxiousnick

So who does the fine pay exactly? Some lawyers, or some part of the government? Sounds to me more like "I caught you stealing from my client, so pay me a tiny fraction of your profits and my client will leave you alone."

Trash_Panda

My last Samsung phone was the Galaxy S3, and that was more than enough for me to see exactly what Samsung's business ethics were and that I wanted to have nothing to do with them. Here we are almost 10 years later. Called that shit.

GoyimNose

10 million LOL. They make 10x more money keeping up what they are doing and just paying the fine.

canbot

Phone reviews should all include this information. Don't just test what the phone does when new, test what happens after 12 and 24 months and report what the manufacturers record is when reporting on their new phones.

People should know that this is a product that is designed to fail in a year or two and buy accordingly.

I find it hard to believe that Apple hasn’t made an internal position to advance their software to the point their old hardware can’t handle he system. If we look to how they handle consumer repairs, we see a clear trend to price repairs over the price of their lowest product offering in the same class.

So, how easy would it be then to ram “features” and new methods into the software that requires the speed bump or move to 64bit or multicore systems. By simply not removing that software or simplifying it for their older phones, they can easily cripple through the processor the previous generation product. The advantage is that it also doesn’t look intentional.

I think the question of why Apple doesn’t allow downgrades is a very good one. It would be very easy to check performance and speed if the consumer could choose to run older OS versions and or enable and disable features on a more granular level that was forced on them in the new updates.

It’s clear these practices benefit the company far more than just a new product offering. This is most likely a decision they’ve made specifically to boost sales.

If you own a cellphone, you do not care about privacy or security.

Cellphones are a technological misstep, and you should feel bad for using them.

Silicon Valley parents are even making nannies sign 'no-phone' contracts to make sure their kids are not exposed to this tech:

Trash_Panda

And here you are using a computer

paunchy225

Fined? Lol who cares. It won't change anything. They rake in money hand over fist. The people paying for the phone are the ones paying the fines

RedHawk

Good news, didnt know Samsung was doing this as well. No wonder theyre worried about huawei.

UnknownAlias365

You never noticed Samsung galaxies getting stupidly slow after roughly the 6-12 month range?

Le_Bucheron

My note 4 is still fast and battery charge last 48 hours after 4 years. I'm still looking for a good reason to drop 1000$ for the new note. My previous phone before that was the galaxy s2. I'm still using it with an aftermarket battery to listen to music at work.

RedHawk

Honestly I keep changing my phone every 3 months or so.

UnknownAlias365

That's not smart lol but that's your choice I guess.

RedHawk

Its a waste of money, but at least i never buy apple products.

15123281?

I still got mine from five years ago. s3 mini. Meh, it's slow but it still works!

blueskywins

Fuck the fines, they don’t hurt them. We need jail time to get the point across. Jail tome for whatever top exec greenlit this.

Landwhaleonline

That is precisely why they only ever get fined.

Mimar

No corporate board would ever see jail time while we still have Corporate Personhood. End the 13th Amendment.

Trash_Panda

How is the 13th amendment related

Mimar

Sorry, fat fingers and not proof reading. Meant to write 14th Amendment.

This article goes into a little detail about how it started.

TheKobold

They would just push that jail time down to the lowest level of management acceptable and some poor schmuck would be the scapegoat. I think what would really work would be sanctions against the company or blocking their merchandise from your Market

Womb_Raider

Force them to offer refunds on the affected devices. They’ll go belly up if they lose a sale based on their forced degradation.

TheKobold

Sounds like a decent ideal

salvia_d

Jail time plus a fine that hurts, $200 billion sound about right for a first offense.
