Being shot doesn't mean instantly dying. He was confirmed dead, yes; he wasn't confirmed dead the instant the bullet hit him.

When a shooting of this nature takes place the police do not just leave the victim to his own resources as the video shows they plainly did in this instance, which is additional testimony the whole thing was staged.
