Oh please, this is hardly a joke about Scalia's death. There's valid criticism and then there's going on a witch hunt.

The joke, and it's a minor one, is about how one of the things Obama has to do before his term ends is, among many other things, appoint a supreme court justice (for added effect he says judge, but we know what he's talking about). It's funny because of the juxtaposition of a very uncommon and serious duty with the trivial act of list making. If anything you could complain that he's making light of the duties of his office, but to claim that he's cracking a joke at Scalia's expense or because he's reveling in power is IMO just manufacturing BS reasons get irate. Sure Obama has made mistakes, but here? Oh please.
